Bombardier Transportation announced today that it won a contract with the Agence metropolitaine de transport (AMT) to provide locomotive and passenger rail car maintenance service for part of the AMT fleet. The value of this three-year contract, awarded following a competitive tendering process, is approximately $34 million CDN ($31 million US, 23 million euros) to which mobilization activities are added.
“The Montreal commuter rail system is undergoing an important transformation and we are very pleased to be able to contribute in collaboration with the AMT, to one of this continents most important public transit agencies,” declared Raymond Bachant, President, Bombardier Transportation, North America.
Ann MacDonald, Vice President, Business Development and Communications, Bombardier Transportation North America, commented: “By winning this bid, we are reiterating our commitment to Montreal and its mass transit system. We are delighted to be able to work with the AMT again.”
This new maintenance service contract means that Bombardier will be fully responsible for the maintenance of rolling stock for the Dorion-Rigaud, Blainville-St-Jerome and Delson-Candiac lines over the next three years. The Bombardier team will gradually mobilize itself over the next few months with a view to taking over all maintenance on July 1, 2010.
An established Bombardier customer, the AMT is the second largest commuter train transit system in Canada and the sixth largest region in terms of traffic in North America. In addition to operating the commuter trains in the metropolitan area, the AMT is the organization responsible for planning, integrating and coordinating mass transit services in the Greater Montreal area. Over the years, Bombardier has provided the AMT with commuter rail cars, electric multiple units and aluminum BOMBARDIER BiLevel cars, and since fall 2009, Bombardier has begun the delivery of 160 stainless-steel multilevel commuter rail cars. In 2008, Bombardier also received an order for 20 dual-powered locomotives, scheduled for delivery in 2011.

I got Snickers! I got Peanut MMs! I am trying to make some money! This isnt for school, this isnt for a basketball team, this is for ME! So I can get more candy and MAKE MORE MONEY!” The straphangers appreciate his no-malarkey sales pitch and his entrepreneurial spirit. He does a bit of business, and a few people just give him a buck and skip the candy. His name is Will, and he is not turning down a dollar. But its a tough hustle: Accounting for the cost of his product and his subway pass, it takes him about three hours to earn $20 free and clear, an implied wage of $6.67 an hour–well under minimum wage. On the other hand, its tax-free, and he sets his own hours. Will wants to go to college–and then what? “Be an independent businessman.” Hes already that, and, if persistence really does pay, hes going to do fine for himself. Theres a whole weird little economy on the subway, from candy hustlers like Will to the Chinese ladies who sell pirated DVDs of movies that have just opened in the cinemas. There are acrobats and mariachi bands, good old-fashioned panhandlers, poets, preachers, and percussionists. Its all part of the famous entrepreneurial bustle of New York. But stay on that No. 4 train a few more stops, north of Harlem and into the Bronx, and that entrepreneurial energy evaporates. Not far from the Kingsbridge Road stop is the Eighth Regiment Armory, a fantastically out-of-place 575,000-square-foot brick castle. Its been a lot of different things over the years–barracks, homeless shelter, boat-show venue, a pre-creepified set for Will Smiths I Am Legend–but it currently is vacant, as are a lot of buildings in the Bronx. Passing by, late on a weekday morning, is a local who calls himself “C,” a black man as sturdily built as the armory itself. C very much wants a cigarette. This is a problem, because he is not currently in funds, in no small part because he does not have a job. In fact, at 35 years old, C has never held a job. His friends, acquaintances, known associates (C is a little foggy on whether hes on probation or parole, but hes got some known associates): no jobs, never really had them. His father? Do not ask C about his father. In fact, the only people C can think of who have jobs are women: His mother worked, the mother of his children works. He did know a woman who was dating a taxi driver once. C says he would like to work but is more of an independent businessman. He describes the informal work he has done as “this and that,” and says he would like to “have his own place,” a bar or a nightclub. But dont expect to see him selling candy on the No. 4 train anytime soon. Asked about the recently defeated plan to convert the gigantic fortress that looms over his neighborhood into a shopping mall, C says he hasnt heard about it. If the plan had gone through, Manhattan-based developer Related Companies would have received about $50 million in tax subsidies for a project that would have created as many as a thousand retail jobs and, during its construction, employed a thousand or more highly paid union hardhats. But the city council killed the project. The Bronx delegation demanded that Related enforce upon its leaseholders a requirement that all of the jobs in the mall pay at least $10 an hour, plus benefits, much more than the prevailing wage in the Forever21-and-food-court racket, to say nothing of the $7.25 minimum wage. So a $300 million project, and a couple of thousand new jobs in a neighborhood that needs them, never happened. Bronx borough president Ruben Diaz Jr. infamously declared: “The notion that any job is better than no job no longer applies.” The New York Post pithily pointed out that when it comes to real jobs, Diaz has never had one–not in the private sector, anyway–and neither has any other member of the Bronxs city-council delegation: All are lifelong politicians, many of them having held elected offices or political appointments since their early 20s. Diaz himself has been an officeholder since he was 23 years old. Its good work, if you can get it. But theres not much other work to be had in the Bronx, where unemployment is currently at about 13.1 percent. Much of the Bronx is young and black or young and Hispanic. Nationally, the unemployment rate among blacks rose to 16.2 percent in the year-end numbers, while the rate for whites fell to 9.0 percent. For black youths, the numbers are startling: 50 percent for 16-19-year-olds, 26 percent for 20-24-year-olds. A study from the Community Service Society of New York puts actual work-force participation among black men 16-65 years of age in New York City at about 50 percent, and the number for young black men nationwide is just 40 percent.
NEW YORK — Richard J. Arsenault of Neblett,
Beard Arsenault, along with co-counsel have filed a class
action lawsuit against Toyota Motor Sales and Toyota Motor Corporation
in the United States District Court Southern District of New York (10
CIV 0900).
In the lawsuit, vehicle owners allege that Toyota concealed the true
nature of the defect in their electronic throttle controls by initially
claiming that their vehicles’ sudden acceleration problems were caused
by floor mats. In doing so, the suit alleges that Toyota engaged in
deceptive conduct and breached expressed warranties.
“Uncontrollable vehicle acceleration is obviously a very serious and
potentially life-threatening problem. The questions include what did
Toyota know, when and why did this happen in the first place. This
lawsuit seeks to compensate the many victims of both economic and
physical harm,” said Arsenault, a veteran of class action and consumer
protection litigation.
Arsenault claims Toyota’s misconduct has had a serious financial impact
on its customers, who have seen their car values drop radically after
the recalls were announced.

in women with dense breasts.

detect abnormalities earlier in the fight against breast cancer.”
The initiation of this multi-center study, which intends to recruit over
20,000 women, is an important milestone for U-Systems in evaluating new
approaches to improved cancer detection. Screening mammography can be
limited in women with dense breasts and these women may have a higher
risk of breast cancer. ABUS uses ultrasound (sound waves) at a safe
frequency to create images of the breast tissue. Ultrasound may
demonstrate cancer not visible with mammography in women who have dense
breasts. U-Systems has developed the somo•v and is sponsoring the
SOMO•INSIGHT clinical study to address the critical need of improved
breast cancer detection in dense breasts.

SAN MATEO — Sewage spills in late January on both sides of the Peninsula resulted in three beach closures, one of which is still in effect. Heavy rain Jan. 19-20 caused sewer lines to overflow in five different locations in San Mateo, pushing 159,000 gallons of raw sewage into the streets — and into the Bay via storm drains, records show. Surfers Beach in El Granada was closed Jan. 28-30 after a sewer line ruptured, sending 300 gallons of sewage toward the beach and the ocean. El Granada Sanitary District General Manager Chuck Duffy attributed the leaks to a tree root puncturing the sewer main, which also caused an overflow Jan. 19, although that sewage was contained before it reached the ocean. Coastside and Bayside beaches are frequently posted with warning signs at this time of year, when local waters exceed health limits for bacterial indicators such as E. coli, fecal coliform and enterococci. But it is unusual for a beach to be closed outright. That only occurs when the bacteria comes from a known sewage spill, said Robyn Thaw, spokeswoman for the San Mateo County Health System.

One of the most interesting and potentially valuable developments for traders is the emergence of binary options as an accessible tool. Binary options are part of a class of options known as exotics, though in reality they are quite simple as they expire at all or nothing and can provide traders and investors a powerful mechanism for reducing risk. And binary options with hourly strikes generates unprecedented flexibility in their tactical use, particularly as a substitute for stops. Lets consider an example in the euro. In recent months a forex trader considering the EUR/USD has seen the Average True Range (ATR) of the day approaching 147 pips and the ATR of the week more than 300 pips. These wide ranges generate a great deal of volatility and wide price swings. As a result, the probability of being stopped out becomes high. Traditional technical approaches such as placing stops above or below the previous days highs or lows, or above or below Bollinger bands, provide protection but often require the stop distance to be quite large. This is where a binary forex option can help out. Putting on a binary option means that the trader is “paid” when the binary strike price is surpassed. The affect is getting “rebated” when the price moves against you but still being able to remain in the spot position. It is analogous to an auto insurance company paying for small damage repair while the car is drivable. At Nadex, a binary option contract pays out $100, which represents 10 pips on a standard contract of $100,000. If a trader chooses to go long or short the EUR/USD, he can purchase binary options to hedge that position. Lets assume that the trader goes short one standard contract in the EUR/USD at 1.4970 at 9 a.m. Instead of a stop loss, he buys an 11 a.m. binary option at >1.5020 offered at $20. This means that if the price exceeds 1.5020 at 1 1 a.m., Nadex will pay his account $100. At 11 a.m., the trader also can decide to buy another binary option to offset any further reduction in the value of his spot account. He could put on five contracts and be completely hedged, and if EUR/USD surpasses that strike, it would result in a $400 net gain versus a loss of $500 on the spot price. If the spot position does not reverse against the trader, the total costs would be $100, which is equivalent to only 10 pips. This is a relatively low cost protection premium. Generally, buying binary options as a substitute for stops can enable the trader to endure a market reversal against him, and stay in the position, anticipating that the reversal of fortune was temporary. The cost of being wrong becomes reduced by the payoffs as the price moves against the position. The major question is whether the cost of the binary options is worth the risk. The risk of course is that the reversal is not serious and the protection was not necessary. As a result, the trader is over-insured. Becoming proficient in using binary options instead of stops also entails timing the entry and exit. The binary option can be left to expire in the money or worthless, or it could be traded for short-term gains.

THE EXERCISE: Scoop/Slam WHAT IT HITS: Core HOW IT APPLIES: The vertical vector of core training is the most trained movement pattern of the three (the other two are diagonal up and down, and across the body; we covered the former last month). Its aligned with the midline of the body, is the strongest and most stable area of the core, and is involved in virtually every physically strenuous task where military, police and fire personnel are concerned. The scoop and slam movement patterns train the up (scoop) and down (slam) axis in the center of the body. HOW TO DO IT: To execute a scoop movement, begin in a quarter- to half-squat position with your feet hip-width apart, back flat and core tight, holding a medicine ball between your knees. Explosively extend your hips, knees and ankles, and throw the ball underhand as far as possible; release it between shoulder and head level. Retrieve the ball and repeat. For beginners looking to develop strength and learn the pattern integration, execute this movement without the release. Make sure not to hyperextend your lumbar spine at the top or collapse your core at the beginning. For the slam portion, begin with your feet about hip-width apart and the medicine ball (we recommend using a “dead” med ball that doesnt bounce such as one made by Dynamax) overhead, reaching as high as possible without overarching your spine. Throw the ball straight down to the floor as hard as you can by explosively flexing your hips and knees, and releasing the ball around knee level. Then pick it back up and repeat for reps. To improve power, slam the ball off the floor to a partner. Keep your core tall and stable throughout the movement. Just as with the scoop, beware of hyper extending your spine at the top or allowing your core to fold at the bottom.

NEW YORK — Despite performance improvements late last year, loss frequency will
remain heightened for U.S. prime auto ABS in 2010 with unemployment
expected to remain in the 10% range for much of 2010, according to Fitch
Ratings.
After hitting record highs in 2009, U.S. prime auto loan ABS loss rates
posted improvements in the final months of last year. Prime annualized
net losses (ANL) were at 1.52% in December 2009, a 6% improvement
compared to November. On an annual basis, loss levels have improved 23%
against December 2008, supported by improving and stable used vehicle
values which drove recovery rates higher throughout most of 2009.
December posted the fourth consecutive year-over-year improvement in ANL.
Prime auto loan ABS exhibited solid rating performance in 2009, despite
declining asset performance and elevated loss levels. Fitch issued 33
rating upgrades in 2009 versus 36 in 2008. There were six prime
downgrades issued on just two transactions in 2009, virtually unchanged
compared to 2008. Stable ratings performance is attributed to several
features present in auto loan ABS including transaction loss proxies
being derived utilizing performance data from the weakest performing
vintages (2007 and 2008); and structural features including quick
amortization along with building credit enhancement levels.
Fitch expects both delinquency and losses to improve in the first
quarter of 2010 driven solely by seasonal patterns. Workers getting
back to work from the holidays, bonuses, and also tax refunds and
rebates all aid consumers during the first few months of the year, said
Senior Director Hylton Heard.
Fitch believes that loss severity will be less of a factor in 2010, as
the new and used vehicle markets adjusted capacity by severely cutting
production levels and thus reducing supply into the used vehicle market.
Risks that could drive loss severity higher in 2010 include weakness at
the manufacturer level, which would then affect brand values and
ultimately depress recovery rates on defaulted loans.
ATLANTA — The U.S. Small Business Administration is reminding small businesses
affected by the severe storms, flooding, tornadoes and straight-line
winds that occurred between May 3-20, 2009 that March 1 is the
filing deadline for Economic Injury Disaster Loans.
Small businesses and most private non-profit organizations in the
following counties are eligible to apply for SBA Economic Injury
Disaster Loans: Breathitt, Clay, Floyd, Jackson, Johnson, Knott, Lee,
Letcher, Magoffin, Martin, Morgan, Owsley, Perry, Pike and Wolfe in Kentucky;
Buchanan, Dickenson and Wise in Virginia; and Mingo in West
Virginia.
Loans are available up to $2 million for eligible entities that suffered
substantial economic injury from the disaster. These working capital
loans may be used to pay fixed debts, payroll, accounts payable, and
other bills that could have been paid had the disaster not occurred.
These loans are not intended to replace lost sales or profits.
The interest rate on these loans is 4 percent, with a maximum term of 30
years. The SBA determines the amount of economic injury and the terms of
each loan based on the financial circumstances of the borrower.
Eligibility for the program is based on the size and type of business,
and its financial resources.
AT THE END of October, the White House released figures claiming that money from the $787 billion stimulus package pushed by President Obama had “created or saved” 640,000 jobs. A closer look suggests that the number was inflated dramatically by human error, confusing federal forms, double counting, and dubious assumptions. In Wisconsin, for example, $7.3 million was allocated to the Parkland Sanitary District for work that will not begin until spring. That money is credited with 100 jobs. The correct figure was five jobs. District treasurer Eric Shaffer filled out the form incorrectly, writing down 50; that number was then counted twice, since the money was part grant and part loan. “We are volunteers, and we made a mistake,” Shaffer told the Milwaukee Journal Sentinel.

IN APRIL 2008, The Orange County Register published a bombshell of an investigation about a license plate program for California government workers and their families. Drivers of nearly I million cars and light trucks–out of a total 22 million vehicles registered statewide–were protected by a “shield” in the state records system between their license plate numbers and their home addresses. There were, the newspaper found, great practical benefits to this secrecy. “Vehicles with protected license plates can run through dozens of intersections controlled by red light cameras with impunity,” the Registers Jennifer Muir reported. “Parking citations issued to vehicles with protected plates are often dismissed because the process necessary to pierce the shield is too cumbersome. Some patrol officers let drivers with protected plates off with a warning because the plates signal that drivers are one of their own or related to someone who is.” The plate program started in 1978 with the seemingly unobjectionable purpose of protecting the personal addresses of officials who deal directly with criminals. Police argued that the bad guys could call the Department of Motor Vehicles (DMV), get addresses for officers, and use the information to harm them or their family members. There was no rash of such incidents, only the possibility that they could take place. So police and their families were granted confidentiality. Then the program expanded from one set of government workers to another. Eventually parole officers, retired parking enforcers, DMV desk clerks, county supervisors, social workers, and other categories of employees from 1,800 state agencies were given the special protections too. Meanwhile, the original intent of the shield had become obsolete: The DMV long ago abandoned the practice of giving out personal information about any driver. What was left was not a protection but a perk. Yes, rank has its privileges, and its clear that government workers have a rank above the rest of us. Ordinarily, if one out of every 22 California drivers had a license to drive any way he chose, there would be demands for more police power to protect Californians from the potential carnage. But until the newspaper series, law enforcement officials and legislators had remained mum. The reason, of course, is that the scofflaws are law enforcement officials and legislators.

In “Are Property Rights Enough?” (November), Kerry Howley wins, hands down. Not only does she present the most compelling vision of liberty, but neither Todd Seavey nor Daniel McCarthy seems to have grasped her main argument. For instance, Seavey posits a “cultural agenda she is pushing.” But Howley values “tolerance for human variation, aversion to authoritarianism, and what the libertarian economist F.A. Hayek called a preparedness to let change run its course even if we cannot predict where it will lead.” That does not sound like pushing a cultural agenda. McCarthy writes that “the idea that only traditional attitudes, never progressive ones, can be oppressive strikes me as naive.” But Howley does not speak of traditional attitudes vs. progressive ones. She speaks of oppressive attitudes vs. tolerant ones. Coercion is coercion, whether the means through which it is enforced are militant, political, or social. Groups exert influence on the individual through disgrace, ostracism, and mob violence. A true friend of liberty should abhor, or at least question, all of the above.

WASHINGTON — With a season of record-breaking snowfalls and eight weeks of winter to
go, Washingtonians have become all too familiar with the icy sidewalks,
the sore muscles, and the coughs and colds that come along with winter
weather. But for those feeling the effects of a recent fall or tighter
joints due to a lack of exercise, therapeutic massage – including simple
tips you can do at home – can offer much-needed relief.
“We tend to be less active in the cold weather months, catch more colds

WINCHESTER, Calif. — Ruth O’Donnell has spent years preparing herself to help people
suffering from disability and illness. A graduate of the University of
North Dakota, O’Donnell is a licensed, registered occupational therapist
(OTR/L). She was looking for a different kind of challenge when offered
a job by the national nonprofit organization Help Hospitalized Veterans
as a Craft Care Specialist (CCS). When the position opened at the St.
Cloud VA medical center, other VA employees who were aware of her skills
and background thought she would be a perfect fit.
O’Donnell, who has been a CCS for the past five years, says she has
never regretted the decision. “Helping veterans work on their fine and
gross motor skills through active participation in arts and crafts is
very satisfying. They are so grateful to have the arts crafts that
Help Hospitalized Veterans (HHV) provides. It’s fantastic to watch their
self-esteem rise with each new kit.”
O’Donnell works with several wards throughout the hospital. “The TBI
patients can have great difficulty with their attention spans, but
working with the kits really helps improve their concentration skills.”
O’Donnell has a deeply rooted compassion for veterans, as both her
father and father-in-law are veterans, and her mother was an employee at
the Fargo VA medical center. She says serving veterans is a natural fit
for her as she remembers fondly the reunions her father had with his
unit in their home when she was a child.
It’s the homeless veterans she works with, however, that have her really
feeling the spirit of Christmas. “We have some veterans that I know are
homeless or living in shelters. Working on the arts crafts is
particularly special for them as they have so very few personal
belongings.”

FHA platform closes record number of construction loans in 2009
BOSTON — CWCapital, a subsidiary of CW Financial Services and a full-service,
national lender to the multifamily and healthcare real estate
industries, announced it has provided $50 million in financing for the
construction of Yale Steam Laundry West, a class-A multifamily property
in Washington, DC. The loan was originated by Andrea (Dee) McClure,
Senior Vice President in CW’s Baltimore, MD office and was financed
through the firm’s FHA platform.
The project, scheduled for completion in 2012, is located in the
historic Mount Vernon Square district of Washington. When completed it
will consist of 218 units, a parking garage, roof deck, pool, clubhouse
and fitness center. In 2006, CWCapital provided construction financing
for its sister project, a 149-unit condominium complex. That project,
completed in January of 2009, is currently 85% sold and included the
historic preservation of two buildings, the construction of two 12-story
towers, a covered parking facility, and onsite storage.
“We are very pleased to provide financing for this project,” stated
McClure. “Despite a decrease in new construction nationally, the
mid-Atlantic region is experiencing job growth, spurring demand for
housing. With limited funding available in the current market, the FHA
has been an attractive source of financing to an increasing number of
experienced multifamily owners and developers.”
This loan is the largest of several new construction loans closed in
2009 for CW, in what has become a trend for the firm’s FHA platform. FHA
construction loans originated last year included $23 million for The
Lodge at Mallard’s Landing in Washington; $18 million for The Lakes of
Millbrook in Alabama; $14 million for The Ridge at Midway in Washington;
and $15 million for two assisted living facilities in Texas. In
addition, the FHA has issued “Invitation Letters” to CW for several
other large construction loans.

“The scene is Capitol Hill. Its the year 2035. Thousands of elderly protesters assemble outside the Capitol building. Inside, the House Ways and Means Committee meets to enact huge cuts in both Medicare and the national health insurance program.” That is the opening of “The Medicare Monster,” a reason article from January 1993; authors Steven Hayward and Erik Peterson highlighted predictions of Medicares impending fiscal insolvency to warn against the push for government-run health care. Substitute 2017 for 2035, and you could write the scene today. Hayward and Petersons cautionary tale pointed out that Medicare costs had been dramatically underestimated from the inception of the program in 1966. Medicare cost $3 billion in 1966. A “conservative” estimate by the House Ways and Means Committee in 1966 projected that Medicare would cost $12 billion after inflation by 1990. The actual 1990 cost was nearly nine times more: $107 billion. Today Medicare costs $408 billion, consuming about 13 percent of the total federal budget. Since 1993 projections about Medicares eventual date of bankruptcy have oscillated considerably. In 1997 the Medicare Trustees projected that its hospital fund would be depleted by the middle of 2000. Fiscal collapse was avoided when the Balanced Budget Act of 1997 imposed what amounted to price controls on physicians and hospitals. As a consequence, in 2000 the Medicare Trustees sunnily projected that the program would be solvent through 2029. Nine years later, the latest Medicare Trustees report projects that the hospital fund (Part A) will be depleted by 2017. The trustees assert that bringing it into actuarial balance during the next 75 years will require either immediately raising the Medicare payroll tax from 2.9 percent to 6.78 percent or cutting current benefits by 53 percent. Medicare Part B, which pays for outpatient care and doctor bills, and the recently added Part D, which pays for prescription drugs, are “both projected to remain adequately financed into the indefinite future because current law automatically provides financing each year to meet next years expected costs.” Translation: About 75 percent of Medicare funds spent on doctors and drugs come from general tax revenue.
Kaiser/VA/DoD partnership piloting a nationwide EHR network Early testing encouraging; improvements in quality anticipated “The ability to share critical health information is essential to interoperability,” said Secretary of Veterans Affairs Eric K. Shinseki in announcing the program. “Utilizing the NHINs standards and network will allow organizations like VA and the Department of Defense to partner with private-sector health care providers to promote better, faster, and safer care for veterans.” The pilot program currently connects Kaiser Permanente HealthConnect and the VAs electronic health record system, VistA, two of the largest electronic health record systems in the country. The DoDs ALTA system will be linked to the other two shortly.

WASHINGTON — With the biggest day of the year for football fans fast approaching,
more viewers may find the game bigger than ever – at least on screen.
According to the Retail Advertising and Marketing Association’s 2010
Super Bowl survey, conducted by BIGresearch, of the estimated 168
million (73.2%) people who will watch the game, at least 3.6 million
(3.6%) will take advantage of retailers’ promotions and buy a new
television, compared to the 2.6 million who said so last year.
Overall, however, consumers will keep expenditures to a minimum, with
the average person expected to spend $52.63 on game-related merchandise,
apparel and snacks, down from $57.27 last year. Total Super Bowl
spending is expected to reach $8.9 billion.*
“With slight improvements in the economy boosting consumer’s confidence,
many people are looking at flat screen televisions as a way to splurge
on something they’ve had their eye on for a while,” said Mike Gatti,
Executive Director, RAMA. “Retailers have restocked their shelves and
are already offering low prices on popular TV brands for those who have
their heart set on watching the game in better quality this year.”
The survey found nearly 32 million people (13.8%) will host a Super Bowl
party and an additional 59 million (25.6%) will attend a party. Grocery,
apparel, electronic, sporting goods and home furnishing stores can
expect to see increased traffic as sports fans head out to buy food and
beverages (71.4%), team apparel or accessories (6.5%), decorations
(6.1%), and furniture or a new entertainment center (1.9%).
Of the millions of people who plan on tuning in February 7 to watch the
Indianapolis Colts play the New Orleans Saints, nearly half (47.8%) say
the game itself is the most important part. Nearly one-quarter (24.3%)
of viewers watch for the commercials, 20.1 percent enjoy getting
together with friends,and 7.8 percent say the half time performances are
most important.
FOSTER CITY, Calif. — Gilead Sciences, Inc. (Nasdaq:GILD) today announced receipt of a
Paragraph IV Certification Notice Letter advising that Teva
Pharmaceuticals submitted an Abbreviated New Drug Application (ANDA) to
the U.S. Food and Drug Administration (FDA) requesting permission to
manufacture and market a generic version of Viread®
(tenofovir disoproxil fumarate).
In the Notice Letter, Teva alleges that three patents associated with
tenofovir disoproxil – U.S. Patent Numbers 5,922,695; 5,977,089; and
6,043,230; and one patent associated with tenofovir disoproxil fumarate
– U.S. Patent Number 5,935,946 – owned by Gilead Sciences are invalid,
unenforceable and/or will not be infringed by Teva’s manufacture, use or
sale of the product described in its ANDA submission.
Gilead is currently reviewing the Notice Letter and has 45 days from the
date of receipt to commence a patent infringement lawsuit against Teva.
Such a lawsuit would restrict the FDA from approving Teva’s ANDA for up
to 30 months or until a district court decision that is adverse to
Gilead, whichever occurs first.
Viread is currently protected by four patents, which are listed in the
FDA’s Approved Drug Products List, and all four patents would need to be
invalidated or expired before a generic version of Viread could be
marketed. The U.S. Patent Trademark Office (PTO) confirmed the
patentability of these four Viread patents in 2008.
Gilead currently has a lawsuit pending against Teva in response to
Teva’s attempts to seek approval for generic versions of Truvada®
(emtricitabine and tenofovir disoproxil fumarate) and Atripla®
(efavirenz 600 mg/emtricitabine 200 mg/tenofovir disoproxil fumarate 300
mg) based on allegations that two emtricitabine patents are invalid,
unenforceable and/or will not be infringed by Teva’s manufacture, use or
sale of its generic product.
ANYONE WHO HAS expended energy arguing for free trade, market competition, and the open exchange of ideas has repeatedly encountered the same obstacle: zero-sum assumptions misapplied to dynamic, nonlinear phenomena. Almost anywhere you see statism advancing–in economic policy, national security, even the basic conditions for free speech–you can bet that underneath theres a faulty zero-sum argument. All complicated matters of life, according to this way of thinking, can be reduced to a simple binary scale: Press your thumb down on the bad end, and the good one will go up. So when President Barack Obama slaps a 35 percent tariff on Chinese tires, as he did on September 11, he does it in the name of ensuring that (as he put it in a campaign promise) “China is no longer given a free pass to undermine U.S. workers.” In this yin-yang formulation, there is a single pie of domestic American tire consumption, and Chinas slice is growing bigger at the expense of domestic producers. Forget the over-all U.S. economy, with its 99.9 percent non-tire-industry workers (and its government-owned, money-hemorrhaging auto companies), all of whom are happy to take advantage of cheaper tire prices. And forget a once-starving country that has catapulted more human beings out of poverty within a generation than any nation in the history of the world. Most of all, forget the famous formulation by Adam Smith, dating back to the Declaration of Independence: “If a foreign country can supply us with a commodity cheaper than we ourselves can make it, better buy it of them with some part of the produce of our own industry employed in a way in which we have some advantage.” You might have thought that the New Democrats routed those zero-sum arguments years ago, perhaps when then-Vice President Al Gore eviscerated Ross Perot while debating the North American Free Trade Agreement on Larry King Live. But Old Democrat economics made a rousing and depressing comeback during the 2006 congressional elections, to the point where Hillary Clinton felt the need to actively campaign against the policies (including NAFTA) of her husband. Ideas long marginalized to the Ralph Nader slice of the left are back in vogue in the mainstream, and everywhere you look you see a pie. “The truth is,” first lady Michelle Obama said in April 2009, “in order to get things like universal health care and a revamped education system, then someone is going to have to give up a piece of their pie so that someone else can have more.”

Dear Tom and Ray: I have heard you refer to “bulletins” (”maybe theres a bulletin on it”) in addressing repair problems. My question is this: If there is, in fact, a bulletin out on a repair, does that mean the dealership cannot (or ought not) charge full price for the repair? My Saturn wagon just had a transmission pressure-control solenoid replaced, to the tune of $800. As I was writing out the check, I noticed a bulletin that the technician had clipped to the bill, and I asked the serviceman if I could see it. He was hesitant, especially when I asked him for a copy of it. Is the bulletin just an aid for the technician to follow, or is it a correction of a defect, and therefore something that should be covered under warranty? — Bill Ray: Good question, Bill. The bulletins we refer to are Technical Service Bulletins, also known as TSBs. They really just contain advice from the company to the mechanics who fix their cars. Tom: For instance, a number of owners of older Honda CR-Vs started complaining about a strange howling noise underneath their cars when they made sharp turns. Someone, somewhere on the planet, figured out that the problem was caused by worn-out fluid in the center differential. Ray: When Honda was convinced that it understood the problem and had a solution (it involved draining and replacing the differential fluid), it issued a TSB, which is the best way to make sure all Honda service people know about it. Tom: Honda sends the TSBs directly to its dealerships. And other companies — namely, Mitchell and AllData — supply the TSBs to subscribing independent shops.
Major progress has been made in restoring
the Digicel network in Haiti. With more than twice the number of cell sites
of its nearest competitor, over 92% of them are now fully operational and
the company has significantly increased its international circuits to
support the major increase in international traffic into and out of the
country.
Over the past two weeks, Digicel technicians have been working to restore
the network following the earthquake on January 12th. The update is as

IWATCH sounds like a sleek new timepiece designed by Apple, but its actually a campaign, launched nationwide in October, urging citizens to report each others suspicious activities. Former Los Angeles Police Chief William Bratton and city police Commander Joan McNamara have teamed up to bring mutual surveillance to 63 cities across North America in what Bratton calls “the 21st-century version of neighborhood watch.” What sorts of suspicious behavior are you supposed to report to the iWatch websites? The program mentions people drawing buildings, wearing clothes that are too big, or otherwise engaging in activities that, in the words of the American Civil Liberties Union, “could be innocuous.” In Los Angeles, a viral video of actors playing concerned citizens focuses on discouraging critical thinking: Instead of recommending careful consideration of a potential danger, a chubby nerd in the online video urges you to “let law enforcement determine if its a threat,” while a skinny, sensitive guy insists that we “let the experts decide.”

Leading HGV insurance specialists Staveley Head have reacted to AB Volvos latest financial results. The Swedish manufacturer has revealed third quarter net sales have fallen by 31% to 4.36bn. Despite this, operating loss has been significantly reduced when compared with the second quarter, as a result of cost cutting measures. This amounted to Pounds Sterling 295.1m, half of the second quarter figure. These announcements come in the wake of an announcement from General Motors that it will be closing down the operations of fellow Scandinavian manufacturer Saab.
It has been a tough year for the haulage industry, with the well documented rise in petrol costs, many businesses have struggled to make ends meet. This, together with difficult trading conditions and a drop in consumer spending has left many firms in difficulty. Clearly, investing in new HGVs is a low level priority at the moment, as a spokesperson for Staveley Head points out:
“The recession has affected HGV manufacturing in the same way it has affected the car industry, so this news comes as no surprise. With many haulage and logistics firms struggling for survival at the moment, investing in new vehicles is not a priority, which has seen demand for new HGVs fall.”

Circle of Health International (COHI), a global
non-profit organization focusing on womens health, announced today that
its second womens health team has arrived in response to the earthquake in
Haiti. This team comprised of one certified nurse midwife, one
MISP-certified physician, and an epidemiologist, has joined the four other
COHI volunteers already working in and around Fonds Parisien, Haiti. UNFPA,
the United Nations Population Fund has estimated that there are 63,000
pregnant women among the survivors of the earthquake, and has recognized
COHIs expertise in preventing more maternal deaths in crisis situations.
Before the earthquake, Haiti suffered from the highest maternal mortality
rate in the Western hemisphere, with 607 women per 100,000 dying in
childbirth.
The COHI team, comprised of midwives and other womens health providers and
public health professionals, will conduct a Rapid Health Assessment to
gather information about the most pressing womens health concerns, provide
desperately needed clinical services, and liaise with other relief agencies
and organizations on the ground to make sure that womens health needs are
addressed as part of the overall relief effort. They will also lay the
groundwork for future COHI teams to continue this important work on behalf
of women. In addition, a second COHI team will be leaving shortly to aid
efforts in Haiti. As the international community acts to bring relief to
the disaster-torn island, COHI is using their expertise to include womens
health needs as an integral part of the overall relief effort, doing their
best to ensure that the devastating earthquake in Haiti does not have a
similarly devastating effect on womens health in the region.

As THE HEALTH care debate dragged on last year, Democrats searched high and low for Republican support. But aside from Olympia Snowe, the ever-coy centrist senator from Maine, everyone with an R attached to his or her name was consistently opposed to Democratic plans. The always-useful bipartisan label remained elusive. Finally, in October, the majority party found four prominent Republicans to support the cause: former Senate majority leaders Bill Frist and Bob Dole, and former health and human services secretaries Louis Sullivan and Tommy Thompson. This was big news: The New York Times, The Washington Post, and ABC News all published stories on the endorsements, and President Barack Obama praised the four Republicans in his weekly radio address. But it turns out the turncoats were not necessarily motivated by bipartisan concern for the greater good. As reported by Timothy Carney in The Washington Examiner, all four had direct financial ties to health care interests that stand to gain from ObamaCare. Dole lobbies for a firm that represents the pharmaceutical industry and insurance companies. Frist has a partner stake in an investment firm that, according to its online description, has “deep expertise in the healthcare reimbursement and regulatory environments.” Thompson works as a health care consultant for Akin Gump, a lobbying firm paid by the pharmaceutical industry, medical device makers, and hospitals.

ACCORDING TO THE conventional wisdom, the United States faces a massive medical bill thanks to our use of pricey new treatments and equipment. “About half of all growth in health care spending in the past several decades was associated with changes in medical care made possible by advances in technology,” a 2008 Congressional Budget Office report declared. “Health care economists attribute about 50 percent of the annual increase of health costs to new technologies or to the intensified use of old ones,” the bioethicist Daniel Callahan writes in his new book Taming the Beloved Beast: How Medical Technology Costs Are Destroying Our Health Care System. This is familiar territory for Callahan, who for decades has advocated reining in medical innovation to reduce health care costs. He also favors limiting the life-extending treatments that older people receive, on the grounds that most of them will “have lived a full and fruitful biographical life prior to age 70.” Interestingly, Callahan, age 79, underwent a life-saving seven-hour heart procedure in August that cost upward of $100,000. In his new book, Callahan complains that “American health care is radically American: individualistic, scientifically ambitious, market intoxicated, suspicious of government, and profit-driven.” Hes right at least about our high-tech vitality: The U.S. does develop and deploy medical innovations much faster than other rich countries. New pharmaceutical products generally hit the market here two years earlier than elsewhere, according to a December 2008 report from the business consultancy McKinsey, which also blames high-tech medicine for escalating costs. The McKinsey report further notes that American physicians are “much quicker to adopt new surgical techniques and advances in anesthesia.” The top five U.S. hospitals alone conduct more clinical trials than any other single developed country. But is high tech medicine really to blame for rising health care costs? Last June Columbia economist Frank Lichtenberg published a study that suggests the opposite. Advanced medical technologies, Lichtenberg suggests, are not contributing to rising American health care expenditures because the money they save makes up for the money spent on them. Lichtenberg begins by looking at how the rate of increase in longevity has varied among U.S. states between 1991 and 2004. He investigates how such factors as the quality of medical care, behavioral risks, education, income, and insurance coverage affect life expectancy. To measure differences in the quality of medical care, he examines how quickly each state took up advanced medical diagnostics and new drugs. He also calculates what fraction of physicians in each state was trained at top-ranked medical schools.

A MAN has been jailed and a woman banned from an area for being nuisance neighbours. Complaints against tenant Stephen Volans and his girlfriend Samantha Whitten, of Holme Park flats, Berry Brow, led to Kirklees Neighbourhood Housing (KNH) taking action. Volans was jailed for 16 weeks and Whiten was excluded from Holme Park Court and the adjoining Bishops Court. An injunction taken out in June this year against Volans and Whitten banned them from using or threatening violence, harassing people and engaging or threatening to engage in conduct that is capable of causing nuisance or annoyance to any individual residing, visiting or engaging in lawful activity within Huddersfield. But Volans continued to breach his order and ended up in court where he was sentenced to 16 weeks in prison.

NEW YORK — The stock market suffered its worst setback in more than 10 months this week as investors decided no matter what the news, it must be bad. The Dow Jones industrial average slid 216 points, or 2.1 percent, on Friday, its fourth big drop in five trading days. Wednesday- Friday, the Dow lost 552 points, or 5.2 percent. All the major indexes fell more than 2 percent Friday. Stocks have had their worst showing since they began their recovery last March. The market also is seeing the the kind of volatility that dominated the markets long slide — the Dow has had a triple-digit move five straight days for the first time since December 2008. The Dow lost 4.1 percent this week, its worst week since it hit a 12-year low in early March. It had reached its highest level since Oct. 1, 2008, only this past Tuesday, closing at 10,725.43. On Friday, it closed at 10,172.98.

After one parishioner received a prayer scarf from a knitting ministry in San Luis Obispo during a serious illness, a group was formed to begin a knitting ministry at the church. Mercy Retirement and Care Center in Oakland has benefited from this group after receiving more than 25 lap robes and scarves for the care center residents. Over the past two years, more than 26 members have participated in the ministry and the group meets twice a month. The group is open to all ages with the majority being seniors and young mothers. While knitting, members pray for the recipients and attach a prayer greeting to each item. “We are a self-propelling ministry, and we are so fortunate to have the support of the community,” said Gloria Calegari, a member of the ministry. “The materials just seem to appear and we havent had to buy yarn yet.”

One of the Mayo clinics, touted by President Obama as a model for reform, has announced already that it will not be accepting Medicare payments because it does not want to accept Medicare price controls. Both bills include mandates on employers that are guaranteed to reduce hiring, wages, or both. Scores of House Democrats have pledged to vote down any bill that lacks a government-run insurer. We will now see whether they are as good as their word or their threats are empty. Pro-life Democrats in the House may also be tested, since the Senate bill provides federal funding to help people buy abortion coverage.

WE have been so distracted by the health-care debate that we collectively missed an important milestone. Back in 2006, Republicans larded legislation with 9,963 pork-barrel projects, according to calculations performed by Citizens Against Government Waste. In fiscal year 2009, Democrats spent a smidgen less money on 10,160 pork-barrel projects. That number, of course, understates the problem, since it excludes special favors that are not explicit spending. Ben Nelsons shameful deal for Nebraska might be dis-honorable, but its technically not pork. Where do all the special favors come from? The answer is simple, and widely accepted: lobbyists. Lobbyists are the most amazingly productive workers in society. If NATIONAL REVIEW decided to end its archaic and indefensible opposition to pork and instead rally political support for the William F. Buckley Jr. Museum–to be funded by taxpayers and placed on the Mall–it could probably achieve its goal by hiring the right lobbyist. And while hot lobbyists are expensive–Heather Podestas six-person firm is reported to have made $3.4 million this year–they are worth every penny. A recent study by University of Kansas professors Raquel Meyer Alexander, Stephen W. Mazza, and Susan Scholz found that lobbying expenditures on one 2004 tax provision provided $220 worth of benefits for each dollar spent. As a Ph.D.-holding economist, I can assure you with great certainty that 22,000 percent is a good return on investment.

Follow-up calls help avoid readmissions In an effort to improve transitions of care, the nurse care coordinators at Brigham and Womens Hospital in Boston make follow-up calls to patients who have been discharged, identify problems and solve them, and answer questions the patients may have about medication, symptoms, or their discharge plan. The hospital has an average of 53,693 discharges and 59,323 emergency department visits each year and had a 30-day readmission rate of 8.79% for medical-surgical patients in 2009.
JOURNALISTS all over Washington, D.C., have already written the big story for February. The headline will be “Democrats Score Major Win on Health Care.” The lead: “After a bruising battle, President Obama has accomplished what Harry Truman and Bill Clinton couldnt. His friends and foes alike see comprehensive health-care reform as the most significant change in American government in decades.. White House sources say that while the president is of course pleased by the historic achievement, he intends to continue his recent focus on the economy and jobs in the months ahead, and signs of economic recovery will soon result in a political recovery for the Democrats.” Passage of health legislation is probable, though not nearly as certain as the Washington consensus would have it. But the extensive debate over the legislation has revealed more opportunities for conservatives than anyone imagined possible a year ago. Moreover, that debate will not end if the Democrats bill passes–and in fact, the opportunities may increase. The resilience of conservative attitudes on the part of the public is the chief reason those opportunities exist. The reigning assumptions a year ago were that the financial crisis had made the public much more favorable toward government activism than it had been during the age of Reagan, and that the new presidents eloquence would allow him to rally the public behind his agenda. Neither assumption proved true. The polls show a public that is skeptical, even resistant, toward big government in general and this health legislation in particular. President Obamas statements on health care have failed to arrest, let alone reverse, the growth of opposition. As the new year began, the chief political argument impelling congressional Democrats to enact the legislation was no longer that it would be popular, but that passing the bill would let them change the subject. Passage would indeed be historic: There is no modern precedent for such sweeping legislations becoming law without a public consensus in its favor. Republicans were supposed to be powerless over health legislation, marginalized in the House and unable to sustain a filibuster in the Senate. They were nonetheless able to drive much of the public debate. They did so by resisting the temptation to accept the inevitability of a liberal health-care overhaul and make a deal that would have merely tinkered with it around the edges–the only sort of deal that could have been on offer, given the balance of forces in Washington. The Democrats were not even willing to meet the Republicans halfway on tort reform, which would not have required them to abandon any of their bills core elements.

IRVINE, Calif. — Glen W. Bell, Jr., 86, founder of the Taco Bell restaurant chain, passed
away last evening in his home in Rancho Santa Fe, Calif. Bell was born
September 3, 1923 in Lynwood, Calif. He is survived by his wife of 54
years, Martha (“Marty”); three sisters, Delores, Dorothy and Maureen;
daughter, Kathleen; two sons, Gary and Rex; and four grandchildren,
Brandon, Jordan, Valerie and Christopher. Private funeral services are
being planned for family members.
One of the founding fathers of fast food and pioneer of the Mexican
Quick Service Restaurant, Glen Bell is best known for founding Taco
Bell, the world’s leading and most successful Mexican QSR chain. His
leadership philosophy and customer focus inspire a culture of innovation
that lives on today and positions the brand for a bright future. Today
Taco Bell serves more than 36.8 million consumers each week in more than
5,600 restaurants in the U.S. More than 2 billion tacos and 1 billion

Baker, who also started his own restaurant Baker’s, had closely studied
the success of the McDonald’s brothers and their namesake burger
establishments first founded in San Bernardino. The car culture was
booming in 1948 and Bell was on the cusp of developing restaurants that
offered revolutionary changes to its customers. These restaurants had
drive-ins, streamlined menus and quick service, which met a growing need
of customers to eat on the go.
Bell’s Drive-In first served a menu with hamburgers and hot dogs to its
customers. However, Bell soon decided to differentiate his menu by
adding Mexican fare. He quickly realized the need to develop a
convenient way to serve items such as tacos in a take-out environment.
He also began experimenting with a drive-thru concept. Once he perfected
his taco shell recipe, taco sauces and the convenient drive-thru
concept, he was ready to introduce the tastes and textures of Mexican
food to mainstream America.

Edge is offering Britons the unique opportunity to be part of the first ever election broadcast generated completely by the public, telling politicians what they personally would like to see change in the education system. The broadcast will make the case that practical and vocational learning needs to be at the heart of every young persons education to enable them to fulfil their talents.
The world is changing rapidly but the education system is failing to change at the same pace, with over nine in ten parents (92 per cent) believing that changes need to be made to the education system. Three quarters of young people (74 per cent) say that the current system needs to be changed to better meet their needs. In fact, 78 per cent of the general population agree that there should be more quality practical and vocational learning opportunities on offer to young people in schools, colleges and universities.
Following the launch today of a striking advertising campaign encouraging the public to Have Your Say , the broadcast itself will be released on 16th March – either immediately preceding the general election itself, or ahead of the expected launch of the political parties campaigns depending on the date of the election.

median of 3.5x. In the five-month interim ended Nov. 30, 2009, coverage
was 4.5x.
SALT LAKE CITY — A man convicted of using a toy gun to rob an area bank was sentenced to more than four years in prison Tuesday. Albert Roy Martin, 61, was sentenced to 51 months in prison, followed by 48 months of supervised release, for an Aug. 14 robbery of Key Bank, 2299 S. Highland Drive. Prosecutors say he entered the bank, showed employees a handgun and left with about $7,000. The entire exchange was caught on camera. U.S. District Judge Ted Stewart noted that this was the second time Martin had committed a robbery and had also been faced with charges of attempted aggravated assault.
